Swan provides aquatic facility management, event and private lifeguard staffing, swim instruction, and safety certification training, among related services. Specific deliverables, pricing, scheduling, and obligations for paid engagements are governed by the proposal, quote, booking confirmation, or written agreement applicable to your engagement, which control if they conflict with these Terms.

• Quotes and proposals are estimates and may change until confirmed in writing.
• Bookings are confirmed upon our written acceptance and, where applicable, receipt of any required deposit.
• Fees, minimum booking durations, payment schedules, and applicable taxes are set out in your quote, booking confirmation, or agreement.
• Late or non-payment may result in suspension of services and additional charges as permitted by your agreement and applicable law.

Cancellation and rescheduling terms, including notice periods and any applicable fees, are described in your quote, booking confirmation, or agreement. Please contact us as early as possible if you need to change a booking.

If you opt in to receive text messages from us, our SMS program is described in our Privacy Policy. Message and data rates may apply, message frequency varies, you may reply STOP to opt out or HELP for help, and consent to receive texts is not a condition of purchase.

The safety of participants, guests, and staff is our highest priority. You agree to follow all posted facility rules, the lawful instructions of our staff and lifeguards, and applicable health and safety requirements. Aquatic activities involve inherent risks; specific waiver, release, and assumption-of-risk terms may be provided separately for certain programs, events, or courses and must be completed where required.

All content on our websites — including text, graphics, logos, course materials, program names, and characters — is owned by or licensed to Swan and protected by intellectual-property laws. You may not copy, reproduce, or distribute our content without our prior written permission.

Our websites and content are provided “as is” without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, Swan will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our websites. Liability for paid services is governed by the applicable agreement.

You agree to indemnify and hold harmless Swan and its officers, employees, and agents from claims arising out of your breach of these Terms or misuse of our websites or services, to the extent permitted by law. These Terms are governed by the laws of the State of California, except where a specific engagement agreement provides otherwise.
